1. Description of Promotion

Welcome to the Crazy Time Leaderboard promotion (the “Promotion”), where, subject to these Terms and Conditions, eligible participants who satisfy the Promotion Requirements (as defined in Section 4 below) during the Promotion Period (as defined in Section 2 below) will receive the Promotion Bonus (as defined in Section 5 below).

The Promotion is sponsored by TSG Interactive US Services Limited (the “Sponsor”). In these Terms and Conditions, a reference to “you”, “your” or “participant(s)” is a reference to persons wishing to participate in the Promotion. Participation in the Promotion and redemption of the Promotion Bonus is expressly conditioned upon your acceptance of, and compliance with all requirements set out in, these Terms and Conditions.  You may be required to sign paperwork issued by the Sponsor.

2. Promotion Period

 

The Promotion will begin at 10:00 AM ET on October 23, 2024, and conclude on 11:59 ET on October 27, 2024 (each such day a “Promotion Day” and collectively the “Promotion Period”).

 

3. Eligibility

To enter the Promotion, you must be at least 21 years of age, have a PokerStars Account (as defined in Section 6 below) and be physically present in New Jersey, Pennsylvania or Michigan when you participate in the Promotion (depending on whether you are playing on the www.pokerstarsnj.com, pokerstarsmtairycasino.com or www.pokerstarsmi.com website respectively). If your social security number is associated with more than one PokerStars Account, you may only earn one Promotion Bonus via one PokerStars Account under the Promotion. Employees, officers and directors of the Sponsor, its affiliates, cable/satellite affiliates, advertising and promotion agencies, retailers, distributors, and each of such employees’, officers’ and directors’ immediate family members and/or those living in the same household (whether legally related or not) of each are not eligible to participate in the Promotion or receive a Promotion Bonus. Individuals who have entered any self-limited or government agency self-exclusion program or have been otherwise excluded from casinos by a government agency, the Sponsor and/or one or more of its affiliates and/or gaming license partners and persons on a Disassociated Patrons, Self-Limit, Involuntary Exclusion, Voluntary Exclusion or Self Exclusion List in jurisdictions in which the Sponsor and/or its affiliates and/or gaming license partners operate are not eligible to participate in the Promotion or receive a Promotion Bonus.

4. Action Required

 

To participate in the Promotion on any Promotion Day of the Promotion Period, access the Eligible Games through the Leaderboard URL (as defined below), use your TSG Account to make one or more Casino wager(s) on the eligible casino games (“Eligible Games”) available for the Crazy Time Leaderboard Promotion (the “Leaderboard”) during the Promotion Period (“Eligible Wager”).

 

The Leaderboard will begin on Monday, October 23^rd at 10:00 AM ET and end Sunday, October 27^th at 11:59 PM. The Leaderboard and the Eligible Games for such Leaderboard of the Week can be found at:

( “Leaderboard URL”).

Wagers placed on a casino game that is not an Eligible Game will not earn any points. You may make an unlimited number of Eligible Wagers during the Promotion Period.

 

Wager Method: log into your PokerStars Account and while playing any of the Eligible Casino Games (as defined in Section 10 below), reach the bonus round game outlined below and earn points. Top 250 places eligible to receive prize.

 

Points will be awarded accordingly:

 

• 5 Points for Crazy Time
• 2 Points for Cash Hunt
• 2 Points for Pachinko
• 1 point for Coin Flip

 

(Together, the “Promotion Requirements”).

5. Claiming Promotion Offer

Upon completing the Promotion Requirements for their respective state, players will earn cash or Casino Bonus that corresponds to their place on the Crazy Time Leaderboard (the “Promotion Bonus”).

Promotion Bonus will be credited to each winner’s PokerStars Account within 72 hours of Winner Selection.

Participants with the same Point totals will be ranked based on who reached the Point total first to who reach the Point total last.

Promotion Bonus recipients will be solely responsible for all federal, state, and local taxes, and for any other fees or costs associated with the Promotion Bonus received, regardless of whether the Promotion Bonus, in whole or in part, is used. The Promotion Bonus value may be reported for tax purposes as required by law.

By participating in this Promotion, you consent to the publication of your full first name and last name initial along with standing (rank and points earned) on such leaderboard on our website and/or mobile applications.

6. Registration Procedures

 

To qualify for the Promotion, you must have an active real money verified account on pokerstarsnj.com, pokerstarsmi.com, or pokerstarsmtairycasino.com (“PokerStars Account”). Creating a PokerStars Account is free, however, you will be required to verify your identity and agree to the Sponsor’s Terms of Service and Privacy Policy for the relevant website (as set out below). If you do not agree to the relevant website’s Privacy Policy and Terms of Service, you cannot create a PokerStars Account or participate in the Promotion.

7. Limitations on Participation

 

In addition to the eligibility requirements in Section 3, the Sponsor reserves the right to refuse or otherwise restrict your eligibility to participate in the Promotion for any reason, in our sole discretion, including based on your wagering patterns or wagering history or if you failed to take advantage of any previous Promotion in good faith. The Promotion is void where prohibited by law.

11. Restrictions on Withdrawal

12. Cancellation

Should you wish to cancel your participation in the Promotion at any time, please contact customer support at support@starssupportnj.com (for New Jersey participants), or support@starssupportmi.com (for Michigan participants). Upon cancellation, you may withdraw any funds you have deposited into your PokerStars Account without restriction. However, any Promotion Bonus amount in your PokerStars Account may not be withdrawn.

14. Additional Terms

Administration:  The Sponsor expressly reserves the right to amend, suspend or terminate the Promotion at any time without prior notice or consent.  Administration of the Promotion is at the sole discretion of the Sponsor.  Sponsor reserves the right to restrict at any time any TSG Account holder from participating in the Promotion for any reason.  Any questions relating to eligibility, these Terms and Conditions or any other questions concerning the Promotion will be resolved at the sole discretion of the Sponsor and its decisions will be final and binding with respect thereto.  No groups, clubs, corporations, companies, partnerships, or organizations may participate in the Promotion or reproduce or distribute any portion of these Terms and Conditions to their members.

Release and Waiver of Liability:  By redeeming the Promotion, participants agree to release, defend, indemnify and hold harmless the Sponsor, its affiliates, gaming license partners, advertising and promotion agencies, directors, officers, employees, representatives and agents from and against any and all liability claims or actions of any kind whatsoever (however named or described) for injuries, death, damages or losses to persons and property which may be sustained in connection with: (i) your participation in the Promotion; and (ii) the receipt, use or misuse of the Promotion Bonus, or while preparing for, participating in, and/or traveling to any Promotion-related activity, including those damages caused by the Sponsor’s own negligence.  The Sponsor expressly disclaims any responsibility or liability for injury or loss to any person or property relating to the delivery and/or subsequent use or misuse of the Promotion Bonus.  In consideration of the Promotion Bonus, each individual hereby agrees and consents, without further authorization, compensation or remuneration of any kind, to the use of such individual’s name, photograph, likeness (including his/her voice), biographical information and statements concerning the Promotion, in any and all advertising, promotions and other publicity conducted by the Sponsor and its affiliates.

Governing Law:  All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms and Conditions or the rights and obligations of participants and the Sponsor in connection with the Promotion will be governed by and construed in accordance with the internal laws of the State of New York, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other laws.

Dispute Resolution:  The parties each agree to finally settle all disputes only through arbitration; provided, however, the Sponsor shall be entitled to seek injunctive or equitable relief in the state and federal courts in New York County, New York and any other court with jurisdiction over the parties.  In arbitration, there is no judge or jury and review is limited.  The arbitrator’s decision and award is final and binding, with limited exceptions, and judgment on the award may be entered in any court with jurisdiction. The parties agree that, except as set forth above, any claim, suit, action or proceeding arising out of or relating to the Promotion shall be resolved solely by binding arbitration before a sole arbitrator under the streamlined Arbitration Rules Procedures of JAMS Inc. (“JAMS”) or any successor to JAMS.  In the event JAMS is unwilling or unable to set a hearing date within fourteen (14) days of the filing of a “Demand for Arbitration”, then either party can elect to have the arbitration administered by the American Arbitration Association (“AAA”) or any other mutually agreeable arbitration administration service.  If an in-person hearing is required, then it will take place in New York, New York.  The federal or state law that applies to these Terms and Conditions will also apply during the arbitration.  Disputes will be arbitrated only on an individual basis and will not be consolidated with any other proceedings that involve any claims or controversy of another party, including any class actions; provided, however, if for any reason any court or arbitrator holds that this restriction is unconscionable or unenforceable, then the agreement to arbitrate doesn’t apply and the dispute must be brought in a court of competent jurisdiction in New York County, New York.  The Sponsor agrees to pay the administrative and arbitrator’s fees in order to conduct the arbitration (but specifically excluding any travel or other costs of participant to attend the arbitration hearing).  Either party may, notwithstanding this provision, bring qualifying claims in small claims court.

LIMITATION OF LIABILITY: TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, THE SPONSOR SHALL NOT BE RESPONSIBLE OR LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, ECONOMIC, EXEMPLARY, PUNITIVE OR OTHER DAMAGES UNDER ANY CONTRACT, NEGLIGENCE, STRICT LIABILITY OR OTHER THEORY ARISING OUT OF OR RELATING IN ANY WAY, DIRECTLY OR INDIRECTLY, TO REDEMPTION OF THE PROMOTION, EVEN IF FORESEEABLE OR EVEN IF THE SPONSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

List of Promotion Winners: For any legally required winners’ list, send a self-addressed stamped envelope to the Sponsor at Attn: Legal Department at 921 Haddonfield Road, 3rd Floor Cherry Hill, NJ 08002. All such requests must be received within 3 months of the Prize Draw.

Governing Law / Limitation of Liability:  All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of entrants, Sponsor or the Released Parties in connection with the Promotion will be governed by and construed in accordance with the internal laws of the State of Florida, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other laws.

 

Miscellaneous:  No waiver of any of the provisions of these Terms and Conditions shall be deemed or shall constitute a waiver of any other provisions hereof, nor shall waiver constitute a continuing waiver unless otherwise expressly provided.  If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remainder of these Terms and Conditions, which will otherwise remain in full force and effect.

 

BY ENTERING THE PROMOTION, ENTRANT AGREES THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (A) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE PROMOTION, OR ANY PRIZE AWARDED, WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (B) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED (IF ANY) NOT TO EXCEED TEN DOLLARS ($10.00), BUT IN NO EVENT WILL ATTORNEYS’ FEES BE AWARDED OR RECOVERABLE; AND (C) UNDER NO CIRCUMSTANCES WILL ANY ENTRANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND ENTRANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGES, OTHER THAN ACTUAL OUT OF POCKET EXPENSES NOT TO EXCEED TEN DOLLARS ($10.00), AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED.  SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY, SO THE ABOVE MAY NOT APPLY TO YOU.
